Daily Ellen – Terms of Use

Please read these Terms of Use ("Terms") carefully before downloading or using the Daily Ellen mobile application (the "App") operated by Daily Ellen ("we", "our", or "us"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Daily Ellen. We may update these Terms from time to time. Continued use of the App after any changes constitutes your acceptance of the revised Terms. We will update the "Last updated" date at the top of this page whenever material changes are made.

2. Description of Service

Daily Ellen is a devotional app for Seventh-day Adventists that provides:

  • Daily Bible verses and Ellen G. White (EGW) quote cards.
  • Text-to-speech (TTS) audio playback of verses and quotes.
  • An iOS home-screen widget displaying the daily verse or quote.
  • Customisable push notification reminders for daily devotionals.
  • A searchable library of EGW books and Bible passages.
  • A Patron subscription that unlocks premium features, available via in-app purchase.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

3. License & Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial devotional purposes.

You agree not to:

  • Copy, modify, reverse-engineer, decompile, or disassemble any part of the App.
  • Use the App for any commercial purpose or for any public display without our prior written consent.
  • Remove or alter any proprietary notices, labels, or marks on the App.
  • Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.

4. In-App Purchases & Patron Subscription

  • Processing – All in-app purchases, including the Patron subscription, are processed entirely by Apple through the App Store. Your purchase is subject to Apple's Media Services Terms and Conditions.
  • Refunds – Refund requests must be submitted directly to Apple. We do not process refunds independently.
  • Patron benefits – Patron benefits are available for the duration of your active subscription. If your subscription lapses or is cancelled, Patron features will no longer be accessible.
  • Price changes – We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of your next billing cycle and will be communicated in advance via the App Store listing.

5. Intellectual Property

  • EGW writings – Quotes from the writings of Ellen G. White are reproduced from the public domain or under license from the Ellen G. White Estate. All rights in those writings remain with their respective rights holders.
  • Bible text – Bible translations used in the App are in the public domain or used under their respective licences.
  • App content & design – All other content, design, graphics, user interface elements, software, and branding in the App are owned by or licensed to Daily Ellen and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce or distribute them without our prior written consent.

6. User Conduct

You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others. You must not use the App to:

  • Transmit any unlawful, harassing, defamatory, or otherwise objectionable content.
  • Attempt to gain unauthorised access to any part of the App or its related systems.
  • Interfere with or disrupt the integrity or performance of the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DAILY ELLEN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Changes to These Terms

We may revise these Terms at any time by updating this page. We will update the "Last updated" date at the top of this page when changes are made. Your continued use of the App after any changes indicates your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through good faith negotiation, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
